ZONING BOARD OF APPEALS
The Zoning Board of Appeals functions pursuant to State Law and the Code of the Village of Russell Gardens. The powers and duties of the Board set forth in the Village Code may be found in Chapter 60, Article IX. The Zoning Board primarily hears and decides appeals stemming from decisions made by the Building Inspector relating to the enforcement of Village Zoning Ordinances.
Accordingly, the Board may interpret the Ordinances and grant Variances. Denial of an application for a variance may be challenged in State Supreme Court.
The Board and its Chairman are appointed by the Trustees of the Village of Russell Gardens. It consists of five members, including the Chairman.
As required by State Law all Zoning Board hearings and deliberations are conducted in public, and are held on an as-needed basis in the Village Hall.
